These terms are an agreement between you and Bela Via, Inc. for the use of the Lobi app. By creating an account you accept them, together with the Lobi Privacy Policy.
Lobi lets you log hotels you have stayed at, rank them, share your rankings with other members, and discover hotels through members whose taste matches yours. Hotel names, addresses, photos and descriptions come from Google and are subject to Google's terms. Lobi's scores, rankings and recommendations are opinions of members, not facts about a hotel, and are not endorsed by any hotel.
"Content" means anything you add to Lobi: stays, ratings, reviews, highlights, photos, notes, comments, your profile, and tags of other members.
Do not use Lobi to:
The Lobi name, wordmark, app design and software are Bela Via's and are protected by intellectual-property law. We grant you a personal, non-transferable licence to use the app on Apple devices you own or control, under the App Store terms. Do not copy, modify, reverse-engineer or resell it.
Lobi relies on Google Places for hotel data, Apple for maps and distribution, and other providers named in the Privacy Policy. Their terms apply to their services, and we are not responsible for their content or availability. Hotel information may be out of date or wrong; check with the hotel before you rely on it.
Lobi is early. Features will change, and some may be removed. We may update these terms; we will post the new version with a new date and, for material changes, tell you in the app. Continuing to use Lobi after a change means you accept it.
You can stop using Lobi and delete your account at any time. We may suspend or terminate your access as described in section 5, or discontinue the service on reasonable notice. Sections 3 (licence, to the extent stated), 6, 10, 11 and 12 survive termination.
Lobi is provided "as is" and "as available". To the fullest extent the law allows, Bela Via disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or that rankings and recommendations are accurate or suitable for any decision you make.
To the fullest extent the law allows, Bela Via and its officers, directors and employees will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of Lobi. Our total liability for any claim relating to Lobi is limited to the greater of US $100 or the amount you paid us in the twelve months before the claim, which today is nothing because Lobi is free. Some jurisdictions do not allow these limits, in which case they apply only as far as permitted.
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in the State of Texas, and you consent to their jurisdiction. If you live in a country whose law gives you the right to sue at home, that right is unaffected.
These terms are between you and Bela Via, not Apple. Apple has no obligation to provide maintenance or support for the app, is not responsible for any claim relating to it, and is a third-party beneficiary of these terms with the right to enforce them against you.
If any part of these terms is unenforceable, the rest stands. Our not enforcing a term is not a waiver of it. You may not assign these terms; we may assign them to a successor of the business. These terms and the Privacy Policy are the whole agreement between you and Bela Via about Lobi.
